The MOBILE Act in Florida was effective on July 1, 2024. This legislation, Senate Bill 1600, created a universal process for licensure by endorsement for health care professions regulated by the Florida Department of Health.
The Florida Board of Acupuncture now implements the review and approval process for licensed acupuncturists seeking to utilize the Mobile Endorsement pathway by following the specific requirements outlined in Section 456.0145 (effective 07/01/2024) of the Florida Statutes.
Here’s how the process typically works:
- Initial Application Submission : Applicants begin by submitting a comprehensive application that includes verification of their licensure from another state, the District of Columbia, or U.S. territories. This application must demonstrate that their practice aligns with the scope of practice defined by the Florida Board of Acupuncture.
- Verification of Licensure : The board verifies that the applicant holds an active, unencumbered license. This means ensuring there are no current restrictions or disciplinary issues associated with the applicant’s license in their original jurisdiction.
- National Exam Confirmation : The board checks to confirm that the applicant has passed a national licensure examination related to their specific profession. This assessment ensures that the applicant has the necessary knowledge and skills to practice safely and effectively.
- Review of Professional Experience : The board reviews documentation or evidence proving that the applicant has actively practiced their profession for at least three years in the four years leading up to their application. This requirement helps ensure that the applicant has adequate recent experience.
- National Practitioner Data Bank Review : The board conducts a background check to confirm that the applicant has not been reported to the National Practitioner Data Bank unless they have successfully appealed such a report. This screening process is critical in assessing the applicant’s professional conduct.
- Disciplinary History Evaluation : The board evaluates if the applicant is involved in any active disciplinary proceedings in any jurisdiction or by the U.S. Department of Defense. This includes reviewing any disciplinary actions taken in the five years before the application submission. Only candidates with a clean disciplinary history are eligible for endorsement.
- Decision and Notification : After completing the review process, the board decides regarding the applicant’s licensure status. Successful applicants are notified and issued a license to practice in Florida under the Mobile Endorsement pathway, while those who do not meet the requirements may be informed of the specific reasons for denial and any possibility for remediation.
By adhering to these steps, the Florida Board of Acupuncture ensures that only qualified and competent acupuncturists are approved to practice in the state, enhancing the standards of care and protecting public health.
