FSOMA has received feedback from its members that applications for a Massage Establishment License have recently been denied to Florida acupuncturists. Denial notifications from the Department of Health included, Florida Acupuncturists were not eligible to act as a “qualified” Designated Establishment Manager (DEM). This is contrary to existing Florida Law, and FSOMA is working to resolve the issue ASAP.
FSOMA is asking any Florida Acupuncturist, who has received a rejection letter and denial of a Massage Establishment (ME) License from the FL Dept of Health/MQA/Board of Massage, to contact David Bibbey, AP/FSOMA Legislative Chair at . Please attach/include copies of any rejection notices from the FL Dept of health or other agency.
Under current law, F.S. 480.033(7) defines “Designated establishment manager” means a massage therapist who holds a clear and active license without restriction; a health care practitioner licensed under chapter 457; or a physician licensed under chapter 458, chapter 459, or chapter 460, who is responsible for the operation of a massage establishment in accordance with the provisions of this chapter, and who is designated the manager by the rules or practices at the establishment.
FSOMA is aware that some members are having challenges applying for/renewing their office’s ME license. This is a high priority issue, so having documented examples of specific instances where licenses have been denied will help FSOMA resolve the matter.
